After the death of my mother, a corporate officer told us, per the contract, they would not refund our recent payment. We paid $5,300 on 11/2 and my mother passed on 11/3. The contract reads: “In the event of a Termination of this lease agreement under any of the conditions set forth in this Termination Section of the Lease the final month's rent WILL NOT BE PRORATED and shall be considered fully earned by the Community.”
My definition of termination of the contract is not death and I posted a review online with our disappointment. The owner of the facility replied to one of the online reviews (from the review): Please contact us at 972-249-5259 so we can at least right the financial part for you during this difficult time.
I did call, and was told by the revenue officer if we took the review down and gave them a five star review, they would send the check. I told him we would not give them a 5 star review, I did agree to take the comments down, and I changed the review to 2 stars.
It has been two months and no refund. The last email from the revenue officer included: Below is the link you can use to update the 2-star rating. Please let me know once this is completed so the refund can be processed. (link was attached). The owner who replied to the online review has not responded to any of the correspondence).
READ YOU LEASE AGREEMENT - this company Silver Leaf Assisted Living and Memory Care / Lake Point Assisted Living own 30 plus facilities in the Dallas area.
We will not ask them again, we will not lie and provide a false rating in order to receive this refund - a refund the owner has made public he would make right.
I do not know how they can make a demand like this, it is illegal for companies to request, but pressuring a grieving family, yes in a difficult time as the owner posted. I research and read reviews for opinions and thoughts. For those who do the same, I want others to know our experience, and want you to have information on the corporate culture of the facility you are considering placing your loved one in and to question the 5 stars you see here.
